What Information We Collect

 

We respect the right to privacy of all visitors to the PhilCare Site. We do not collect information that would personally identify you unless you choose to provide it. For example, if you choose to join the community at the PhilCare Online Community, the Privacy Policy and Terms and Conditions of use of that site apply. The personal information that you submit is shared only with those people in the PhilCare organization who need this information to respond to your question or request. Information submitted through PhilCare Site’s online forms may be collected to ensure technical functionality. It will also be utilized to address any inappropriate use of our website. We do not save personal information to use for other purposes, nor do we provide it to any other organizations. 

    

Email Communications, Newsletter, and Related Services

   

Upon your consent and approval, PhilCare.com.ph provides you with the opportunity to receive communications from us or third parties. You can sign up for a free email newsletter. You can unsubscribe from this newsletter at any time. 

 

Email communications that you send to us via the email links on our site may be shared with a customer service representative, employee, medical expert or agent that is most able to address your inquiry. We make every effort to respond in a timely fashion once communications are received. Once we have responded to your communication, it is discarded or archived, depending on the nature of the inquiry. 

  

The email functionality on our site does not provide a completely secure and confidential means of communication. It’s possible that your email communication may be accessed or viewed by another Internet user while in transit to us. If you wish to keep your communication private, do not use our email.

Surveys

   

We occasionally survey visitors to our Site. The information from these surveys is used in aggregated, de-identified form to help us understand the needs of our visitors so that we can improve our Site. Upon your approval and consent, the information may be shared with third parties with whom we have a business relationship. We generally do not ask for information in surveys that would personally identify you; if we do request contact information for follow-up, you may decline to provide it. If survey respondents provide personal information (such as an email address) in a survey, it is shared only with those people who need to see it to respond to the question or request, or with third parties whom you consented to perform data management services for our site. Those third parties have agreed to keep all data from surveys confidential. 

    

IP Addresses

   

The Web server automatically collects the Internet Protocol (IP) address of the computers that access our Site. An IP address is a number that is assigned to your computer when you access the Internet. It is not truly personally identifiable information because many different individuals can access the Internet via the same computer. We use this information in aggregate form to understand how our site or advertisements from PhilCare are being used and how we can better serve visitors.

• We may provide third parties with non-identifiable aggregate statistics about our visitors, traffic patterns and related site information. These data reflect site-usage patterns gathered during visits to our website each month, but they do not contain behavioural or identifying information about any individual member unless that member has given us permission to share that information. 
• To help us determine the effectiveness of PhilCare advertising, we work with Web analytics tools hosted by third parties who receive non-identifiable information from your browser, including the site or the advertisement you came from, your IP address, your general geographic location, your browser and platform information, and the pages you view within our site. 
• We may be compelled to release information when required by authorized law enforcement investigations or other valid legal processes, with due notice required by law.

Protecting Your Privacy

  Whether you are visiting the PhilCare Site or in one of our clinic locations, we use reasonable security measures to protect the confidentiality of personal information under our control and appropriately limit access to it. We use a variety of information security measures to protect your online transactions with us. The PhilCare Site uses encryption technology, such as Secure Sockets Layer (SSL), to protect your personal information during data transport. SSL protects information you submit via our website, such as ordering information including your name, address and credit card number. If you choose a direct payment gateway to complete your purchase, your card information is encrypted and processed using Payment Card Industry Data Security Standards (PCI-DSS) Compliant systems. That being said, PhilCare cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. We have taken reasonable steps to ensure the integrity and confidentiality of personally identifiable information that you may provide. I hereby give my permission to PHILHEALTHCARE, INC. (the “Company”) pursuant to its Mindscapes mental health program, to include my responses to the questionnaire in their data analytics. This is for the sole purpose of monitoring my monthly stress level and other relevant factors, in order to personalize and improve the service to me as needed.

I further acknowledge and understand the following:

1.Description of the Scale. The Perceived Stress Scale (PSS) is a stress assessment instrument that enables the person to understand how different situations may influence our feelings and our perceived stress. Questions in this scale ask about one’s feelings and thoughts during the last month. It is ideal that when answering this scale to answer quickly with the first thoughts or impressions that come to mind. If no answer is ideal, I shall select the closest reasonable response.

2.Procedures.I understand that I am expected to complete an online test. My records for this assessment will be kept under the care of the Company and the results obtained from this assessment do not reflect any particular diagnosis or course of treatment. Furthermore, I also understand that this tool is meant to help assess and monitor my stress level on a monthly basis.

3.Confidentiality and Data Privacy. My name and any information pertaining to my identity shall be treated with utmost confidentiality by the Company. Likewise, all such information shall be processed by the Company strictly in accordance with all relevant data privacy laws and regulations.

By clicking the “Agree” button below, I expressly agree and acknowledge to the following terms and conditions:

• I understand that this service is extended only to me personally, or to my dependent children of minority age, or a minor entrusted under my guardianship. Thus, I certify that I am an active PhilCare Member and I am consulting for myself or my dependent minor child, or a minor entrusted under my guardianship and not on behalf of anyone else.
• I expressly acknowledge and understand that current PhilCare technology and processes limit the accuracy of mental health examination due to the lack of physical contact and other sensory channels which would provide more comprehensive data. Such limitation also extends to delivery of services such as fulfilment of court-ordered consultation or similar requirement, unless separately contracted and agreed upon.
• I must proceed to the nearest hospital with emergency or urgent care facility if I am, or the dependent minor client is, going through mental health crisis (i.e. definite intention to harm my/his/her self or another person) I understand that appropriate care is needed to such situation and best provided by hospital or similar facilities.
• I shall provide the PhilCare mental health professional with all relevant data about my health, physical condition, mental health history and other pertinent mental health information. I shall answer all questions pertaining to said mental health information truthfully and to the best of my knowledge and ability.
• I accept and acknowledge that mental health consultation not only have benefits, but also potential risks which can be in form of, but not limited to, upsetting feeling, thinking or behaviors. Such events are to be expected as part of change, and that I am required to honestly report back if such occurrence takes place.
• I shall not hold PhilCare, its employees and representatives, or the PhilCare mental health professional liable for any emotional discomfort, inaccuracies in diagnosis, or any ineffectiveness of or damage resulting from any mental health treatment course provided, when the same could not have reasonably been avoided given the limitations of PhilCare technology, or if the same occurred due to my failure to provide truthful or complete mental health information as requested.
• I give my consent for PhilCare and the mental health professional to collect and process all data that I provide, for the purpose of treating my mental health concern or that of my eligible dependent and for related ethical mental health research and reports; and to store said data for as long as it is reasonably necessary for the resolution of said mental health issue or publication or reporting of de-identified, aggregated and anonymized data study.
• I give my consent for PhilCare and the mental health professional to communicate my emergency contact person or employer (if under a corporate account) in the event of a mental health emergency, as assessed by the mental health professional.
• I shall pay all fees and charges associated with the use of the PhilCare service, if any, without need of demand.

In turn, PhilCare and the mental health professional agree to and acknowledge the following:

• The mental health professional is committed to exercising due diligence in the standard of care and will exert all reasonable efforts to complete a proper diagnosis and recommend a proper course of treatment or action; such that in an event of a crisis situation, or upon knowledge and verification of abuse, PhilCare and/or mental health professional will contact the declared Emergency Contact Person and recommend proceeding to an emergency or urgent care facility, or make faithful reporting to appropriate agency as necessary.
• PhilCare certifies that all mental health professionals are duly licensed and are competent in their field of practice.
• PhilCare Mindscapes and the mental health professional must be faithful and dutiful to the provisions of Republic Act No. 11036, the Mental Health Act of 2017, and its implementing rules and regulations in the delivery of services.
• PhilCare and the mental health professional shall abide by the provisions of Republic Act No. 10173, the Data Privacy Act of 2012, and its implementing rules and regulations, in the collection, processing and storage of any data that you shall provide. PhilCare shall treat said data with the utmost confidentiality and privacy and shall not use the data for any other purpose.
• Your availing of the services of a mental health professional shall be without prejudice to your seeking a regular consultation with another counselor, accessing a mental health service provider, or exercising such other options that are available to you.
• PhilCare and/or the Mental health professional shall duly advise you of the value of any fees and charges associated with the service, or a reasonable estimate of the same, if any, prior to your availing of the service.
